Terms & Conditions

These Terms and Conditions apply to all contracts for the sale of goods or stock by Ozzy’s Diecast Models (the “Company”) to the purchaser (the “Customer”) and constitute the entire agreement between the Company and the Customer to the exclusion of all others, except where expressly agreed in writing by a Director of the Company. In the event of any inconsistency between these Terms and those exchanged between the parties, these Terms and Conditions shall prevail. No variation of the Terms and Conditions shall be valid unless agreed in writing by the Company.

  1. All orders accepted by the Company are subject to these Terms and Conditions.
  2. The Company reserves the right to change prices without prior notice. VAT, where applicable, will be added to all prices and charges.
  3. All scales and measurements are approximate. Items listed in the Company’s price list or on its website may be subject to patents or registered designs. The Company reserves the right to withdraw or modify the design or specification of any item at any time without notice.
  4. Orders are accepted by the Company subject to availability of stock. A contract of sale shall only come into effect when the Company dispatches goods to the Customer.
  5. The Company reserves the right to make partial deliveries and to issue invoices accordingly. Each individual delivery will represent a separate contract of sale.
  6. The Company may at any time refuse or cancel the delivery of any order, or any part of an order, without notice.
  7. The Company accepts no responsibility for late or non-delivery. All delivery dates quoted are approximate and subject to amendment without notice. Time shall not be of the essence of delivery. A delivery date will only form part of the delivery contract if agreed in writing by a Director of the Company. The Company shall not be liable for any loss, damage, or expense arising from delays or failure to deliver.
  8. The Company accepts no responsibility for goods damaged or lost in transit unless notified in writing within 3 days of receipt.
  9. Every effort will be made to dispatch complete orders within 5 days. If this is not possible outstanding items will be automatically placed on back order.
  10. All published data relating to goods or stock is approximate. No warranty is given as to its accuracy, and the Company accepts no liability for any direct or indirect loss arising from reliance on such information.
  11. The Company’s Privacy Policy explains what information is held about Customers, how personal data is used, and the Company’s marketing practices.
  12. Title of Goods

    a) Risk in the goods shall pass to the Customer upon delivery, or to any person acting on the Customer’s behalf.

  1. Carriage and Returns

    a) Carriage and packing will be charged at the Company’s current rates. Export carriage, including non-UK mainland addresses, Ireland, and the Channel Islands, will be charged at cost. No allowance will be made for items not in stock.

b) Damaged or faulty goods may only be returned with the Company’s prior consent. Goods must be securely packaged for return. A credit for return postage will be issued upon receipt, provided the cost was agreed in advance. The Company will repair or replace faulty items wherever possible; if a replacement is unavailable, a credit note will be issued.

  1. If either party fails to exercise a right or remedy that it has or which arises under this agreement, such failure shall not prevent that party from exercising that right or remedy subsequently for that or any other incident.
  2. If any of these conditions becomes invalid, illegal, or unenforceable, it will not affect the remaining terms, which shall remain in full force and effect.
  3. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales, and subject to the exclusive jurisdiction of the courts of England and Wales.
